RENT OF THE COMMERCIAL REAL ESTATE OBJECTS CREATING CONDITIONS FOR RECEIVING PROFIT

Features of legal regulation of rent of the commercial real estate objects creating conditions for receiving profit (buildings, constructions, enterprises) are considered. The main problems arising at the conclusion of the lease contract of real estate objects are revealed. The most significant conditions of registration of the contract are given. The author pays special attention to requirements to a form of the contract for rent of the enterprise and gives distinctive features of the contract for enterprise rent. Features of rent of the commercial objects creating conditions for receiving profit are shown: buildings, constructions and enterprises. The special attention is paid to two categories of the rights connected with the enterprise such as: a) rights for a service mark, names of firm and trademark; b) the rights acquired by the lessor on the basis of the license for occupation by the related activity.
